Terms and Conditions for online Workshops

In short: You can withdraw within 14 days of booking, as long as the workshop has not yet taken place. After that, you can cancel until the workshop starts and receive a credit. If I cancel or postpone, you can choose between a refund and a credit. Only my teaching parts are recorded, never the sharing. You receive the replay even if you can't attend live. This workshop is not therapy.

1. Scope and provider

1.1 These Terms and Conditions apply to all bookings of online workshops hosted by me, Jasmin Matzakow, (the "Workshop").

1.2 The Workshop is provided by: Jasmin Matzakow, Oettingenstr. 66, 80538 Munich, Germany, mail@jasminmatzakow.de (the "Provider").

1.3 The language of the contract is English.

2. The Workshop

2.1 The Workshop takes place live online via Zoom. Date and time are stated on the booking page. It lasts approximately 2.5 hours.

2.2 The Workshops included body-based exercises, reflective and journaling exercises, guided hypnotic journeys and group sharing.

2.3 Participants are responsible for a stable internet connection, a suitable device and a quiet, safe place to participate.

3. Booking and contract

3.1 Before completing your booking, you can review and correct all your entries in the checkout. The contract is concluded when you complete the booking and payment in the online shop. You will receive a booking confirmation by email, including these Terms and Conditions. The Provider stores the contract details. These Terms and Conditions can be viewed on this page at any time. The Zoom link will be sent before the Workshop. It is personal and may not be passed on.

3.2 A "Bring a friend" ticket covers two places. The person who books is the contracting party for both places. They are responsible for passing on the access information and these Terms and Conditions to the second participant, and for providing the second participant's name and email address on request.

4. Prices and payment

4.1 Prices are stated in euros on the booking page. Payment is due at the time of booking. Any currency conversion fees charged by your bank or payment provider are your responsibility.

4.2 In accordance with § 19 UStG (German small business regulation), no VAT is charged.

4.3 Bonuses are voluntary additions. They are provided for bookings made by the deadline stated on the booking page.

5. Right of withdrawal

If you are a consumer, you have a statutory right of withdrawal. Details are set out in the Withdrawal Policy below (Section 14).

6. Cancellation by participants

6.1 After the withdrawal period has ended, you can cancel your booking in text form (e.g. by email) until the start of the Workshop. You will receive a credit for the full ticket price. The credit can be used for a future date of the Workshop or another workshop by the Provider. It is valid for three years from the date of issue. It cannot be paid out in cash.

6.2 If you do not attend without cancelling beforehand, no credit or refund is given. You will still receive the replay (Section 8).

7. Cancellation or changes by the Provider

7.1 The Workshop requires a minimum of 2 participants. If this number is not reached, the Provider may cancel the Workshop up to 24 hours before the start.

7.2 The Provider may also cancel or postpone the Workshop for important reasons, such as illness or significant technical failure.

7.3 In case of cancellation by the Provider, or if you cannot attend a postponed date, you can choose between a full refund of the ticket price and a credit for a new date. Further claims are excluded, except as provided in Section 11.

8. Recording and replay

8.1 The Provider's input, the body-based exercises and the hypnotic journey are recorded. Group sharing and personal exchanges are not recorded.

8.2 All booked participants receive the replay, whether or not they attend live. The replay is available for download for 30 days after the Workshop. Downloaded files may be kept and watched for personal use without time limit.

8.3 The replay may not be shared, uploaded, published or passed on to third parties.

8.4 Participants may not record, photograph or screenshot the Workshop or other participants.

8.5 If the recording fails for technical reasons, the Provider will provide a suitable substitute, such as a separately recorded video of the Workshop.

9. Confidentiality and conduct

9.1 What participants share in the Workshop stays within the group. Participants agree not to pass on personal information about other participants.

9.2 Participants treat each other with respect and assume good intentions. The Provider may exclude a participant from the Workshop in case of serious disruptive or disrespectful behaviour.

10. Health, hypnosis and personal responsibility

10.1 The Workshop is an offer of creative coaching and artistic practice. It is not psychotherapy, medical treatment or a substitute for them. The Provider does not diagnose, treat or cure any physical or mental health condition, and makes no promise of healing or of any specific result.

10.2 Participation is at your own responsibility. You decide at every moment how far you engage with an exercise, and you may pause or stop at any time.

10.3 If you have epilepsy, a psychotic disorder, a severe mental health condition, or are currently in acute crisis or psychiatric or psychotherapeutic treatment, please consult your doctor or therapist before participating.

10.4 Never listen to the hypnotic journey or the audio files while driving or operating machinery.

11. Liability

11.1 For damages resulting from injury to life, body or health, and for damages caused intentionally or through gross negligence, the Provider is liable in accordance with statutory law.

11.2 In case of slight negligence, the Provider is only liable for breach of essential contractual obligations. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance participants may regularly rely. In these cases, liability is limited to the foreseeable damage typical for this type of contract.

11.3 The Provider is not liable for technical problems on the participant's side.

11.4 These provisions also apply to any persons the Provider engages to perform the contract.

12. Copyright

All materials, including workbooks, audio files and replays, are protected by copyright. They are for your personal use only. Sharing, copying, selling or publishing them is not permitted.

13. Final provisions

13.1 German law applies. If you are a consumer residing in another country, mandatory consumer protection provisions of your country of residence remain unaffected.

13.2 The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13.3 Information on how personal data is processed can be found in the Privacy Policy.

14. Withdrawal Policy

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform me (Jasmin Matzakow), mail@jasminmatzakow.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

Expiry of the right of withdrawal

The right of withdrawal expires when the service has been fully performed, if you have expressly requested that we begin the performance before the end of the withdrawal period and have acknowledged that you lose your right of withdrawal once the contract has been fully performed.
